ILO MLC 2006: what is going to change in 2013?
The ILO's Maritime Labour Convention (MLC), 2006 provides comprehensive rights and protection at work for the world's more than 1.2 million seafarers. The Convention aims to achieve both decent work for seafarers and secure economic interests in fair competition for quality shipowners.
With the ratification of the MLC, 2006 by Australia last December, 22 ILO member States, representing over 56 per cent of the world gross tonnage of ships, are now parties to the Convention. Of the twenty-two ratifications, twelve have been received in 2011 with the majority of these received in the last six months, which shows that national ratification efforts are now nearing completion in many countries in all regions. It is expected that the additional eight ratifications will be obtained in the following three to six moths making it possible for the MLC, 2006 to enter into force in early 2013.
It is important to note that the MLC 2006 applies to all ships, whether publicly or privately owned, that are ordinarily engaged in commercial activities. It will be up to each flag state to determine the later. Ships over 500 GT will have to be certified. Ships below 500 GT will only be required to undergo inspections every 3 years.
The 14 matters and corresponding regulations that must be addressed in the DMLC are:
- Minimum age
- Medical certification
- Qualifications of seafarers
- Use of any licensed or certified or regulated private recruitment and placement service
- Seafarers’ employment agreements
- Payment of wages
- Hours of work or rest
- Manning levels for the ship
- Accommodation
- On-board recreational facilities
- Food and catering
- On-board medical care
- Health and safety and accident prevention
- On-board complaint procedures
What will be the main changes for the yacht owners and manager?
- Flag state inspections under the MLC2006.
- New standards for crew quarters and work conditions for new builds
- New rules for Health protection, medical care, wel- fare measures and other forms of social protection
- Revised crew employment agreements
At Neo Yachting, we are working to anticipate the changes allowing a smooth transition for our clients.

Motor Yacht EMMY on route to Panama.
MY EMMY is currently being shipped to Panama on the Super Servant 4 and the ETA is December 29. She will be delivered to her new owner who will be using her privately and for charter in one of the most beautiful cruising areas in the Pacific. EMMY will be based in Fuerte Amador Resort & Marina of Panama City just off the Las Perlas archipelago (30 nautical miles) and 200 nautical miles from Coiba Island and the coast of Costa Rica.
The Pearl Islands (Spanish: Archipiélago de las Perlas or Islas de las Perlas) are a group of 100 or more islands (many tiny and uninhabited) lying about 30 miles (48 km) off the Pacific coast of Panama in the Gulf of Panama. The most notable island is Contadora Island (or Isla Contadora in Spanish), known for its resorts. Contadora was said to be used by the Spanish conquistadors as a stop for taking inventory of booty prior to returning to Spain, hence the name (contador means counter or bookkeeper in Spanish). Contadora is a resort island, with many homes owned by wealthy Panamanians.
The largest island, at about 30 square miles (78 km2), is Isla del Rey ("Island of the King"), its name probably a religious reference rather than a reference to a secular king. Isla del Rey has several towns, most notably San Miguel. It is easily larger than the other Pearl Islands combined, and is the second largest island in Panama, after Coiba.
Source: Wikipedia.
Coiba is the largest island in Central America, with an area of 503 square kilometers, off the Pacific coast of the Panamanian province of Veraguas. It is part of the Montijo District of that province.
Coiba's underwater topography is linked by the underwater Cordillera mountain chain to Coco's and the Galapagos Islands. Scientists from the Smithsonian Tropical Research Institute have proclaimed it an unparalleled destination for discovering new species. Rachel Collin, a Smithsonian project coordinator said: "It's hard to imagine, while snorkeling around a tropical island that's so close to the United States, that half the animals you see are unknown to science.”
Its unique location protects it from the damaging winds and other effects of El Niño, allowing it to sustain the uninterrupted evolution of new marine species including whale and tiger sharks, sperm whales, sea turtles, angel rays and giant schools of fish. It is also the last refuge for a number of threatened terrestrial animals such as the crested eagle and several sub-species of agouti, possum and howler monkey (including a Coiba Island Howler Monkey).
The waters adjacent to the island are teeming with marine life. It is surrounded by one of the largest coral reefs on the Pacific Coast of the Americas. The Indo-Pacific current through the Gulf of Chiriqui provides a unique dive environment. The warm current brings with it coral and many of the pacific tropical underwater life that you would not expect on the Pacific Coast of the Americas. Also with it come the larger fish/mammals such as humpback whales, sharks, whale sharks, orcas and more.

New interior decor revealed on MY 360°
It is rare to meet a yacht owner who is so passionate about his yacht and so available! So we have interviewed the owner of MY 360° and asked him about the new interior decor of the yacht revealed last week...
- Who are the artists who helped you with the design?
The 360 yacht retrofit was designed by two California designers, Yvonne Colacion of Colacion Studios and Kathy Troutfetter of Laidlaw Schultz architects.
- What was the inspiration of the interior design?
The classic sweeping lines on the vessel’s exterior was the inspiration for the interior’s modernistic interpretation of art deco design. Colacion Studio and Laidlaw Schultz architects focused on creating an elegant, energetic environment, reminiscent of the 1920's, but with all the amenities expected by today's yachter. The interior is rich in texture and detail, recalling the art deco era with a modern twist, uplifting the spirit and soothing the soul. Colacion Studio and Laidlaw Schultz architects worked with ISA Yachts on the retro fit of the classic yacht pulling from international resources from France, Italy, Japan, Germany, Thailand , as well as the United States for this modern deco interior.
- What was the aim when designing the interior of MY 360°?
Meeting a large while sophisticated design appeal... This luxury yacht offers guests a diversity of socializing and entertainment spaces. Breath taking panoramic views from the Main Salon and Observation deck are further defined by the usage of wenge blinds acting as picture frames for magnificent ocean views. In the Main Salon, while exploring the details of the two decorative screens influenced by the great art deco designer Edgar Brandt, guests are enticed to experience the ocean views once again. This richness of details and finishes continues to engage the guest with ebony accents, fine silk velvets at the sofa and a rich and lush silk and wool carpet throughout the Main Salon. On the Observation Deck the 360 surprises the guest with an uplifting leopard custom wool rug which is both sophisticated and playful. For video entertainment viewing guests are invited into a large seating arrangement grounded by a fireplace opposite a Hollywood inspired art deco sofa and four large comfortable deco lounge chairs, richly detailed with wood accent.
- And does the dream carry on with the guest's accommodations ?
Diversity and surprise inspired the design of each guest cabins. Each room was approached as a unique experience; the Owner’s Suite is bold, rich in art deco influence with it's large ebony headboard, writing desk, rich bedding materials and large seating area. The 360's VIP suite is certainly art deco with a modern twist in it's precise usage of ebony above the headboard, it's large scale decorative mirror and inviting deco lounge chair provided by the great reproduction art deco house, Anne Hauck. The smaller guest cabins are both uniquely different, the starboard cabin offering an uplifting light and elegant experience with its expansive usage of mirror above a delicately carved adjoining headboard. While the port side guest cabin is bold and soothing, this clean bold approach is extended through the forward double cabin.

Monaco F1 Grand-Prix, May 29, 2011
Formula One’s historic street-course race roars through the streets of Monaco each May, and the best seats in the city are onboard the luxurious motor yachts docked in the famous Port Hercule.
Watching from the private deck of a yacht is an exclusive experience that offers not just exclusive views of every twist and turn, but also red-carpet access to post-race hotspots such as Jimmy’z Night Club, one of the most extravagant evening venues in the world.
Yachts are a personalised alternative to busy city hotels. With a private yacht, there is instant access to the high-stakes gaming tables at the Casino de Monaco. Restaurants, clubs, and boutiques in Monaco cater to the world’s wealthiest individuals, with haute couture designers and internationally renowned jewelers dominating the prestigious Cercle d’Or shopping square.
For a more intimate experience, it’s just a short cruise to Villefranche-sur-Mer or San Remo, where colorful markets and stunning hilltop views welcome pedestrians seeking authentic Riviera charm.
Monaco Yacht Charter
For Luxury Yacht Charter, Monaco is literally the center of the yachting universe. Nearly every super and mega yacht on the charter market can be chartered from Monaco, and Monaco is a must-stop destination for charters in the French and Italian Riviera.
Monaco is an easy starting point for charters, as it is just 20 minutes from Nice Airport. The principality, given the luxury tastes of its inhabitants, also offers everything imaginable for provisioning even the most demanding of charters. Please see our French Riviera Charter Guide to immerse yourself in the possiblities of chartering out of Monaco.
If you're chartering a sailboat or small motor yacht, it will most likely be in Fontvieille (the port on the west side of the palace), or in neighboring towns such as Beaulieu-sur-Mer or Villefranche-sur-Mer, as berth spaces in Port Hercule are scarce and very pricy. A delightful day charter from Monaco would include a stop off in picturesque Villefranche, the classy St Jean Cap Ferrat, and a tour around Cap d'Antibes to Cannes and back.
You'll see some of the most expensive coastline in the world, plenty of super yachts, charming ports, and villas owned by Bono, Bill Gates, Paul Allen, and others.
Sailing Yachts vs. Motor Yachts
Chartered sailing yachts come in a huge variety of boat types and designs, from tiny dinghies to larger sloops, catamarans and ketches, to full-size schooners. They are quiet, and for the most part, at the mercy of the winds. Of course, luxury sailing yachts come with diesel engines to make sure that the vessels always arrives at their destinations on time. Preferred for leisurely travels in a general area, sailing yachts require a crew with a specific skill set. Sailing a sailboat entails handling rigging, which a motor yacht doesn't have. On the whole, the amenities on sailing yachts are luxurious but simple, allowing guests to enjoy a relaxing, luxury vacation without the noise of electronic entertainments or diesel engines.
Motor yachts, on the other hand, are all about power. With one or two (or more) diesel engines to power both the propellers and the onboard electronics, motor yachts can offer larger accommodations with more modern entertainments and amenities. Motor yachts commonly have entertainments that require a great deal of electricity, like a hot tub, a disco, a small cinema or a beauty salon. Both sailing and motor yachts have a swimming platform at the stern, a few guest cabins and the crew living area. But, on some motor yachts, the number of crew can equal or surpass the number of guests! More diesel power means more people are necessary to care of more amenities.
